1. Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and WrkStream ("Company," "we," "us," or "our"), an AI-powered business automation agency headquartered in Raleigh, North Carolina.
By accessing our website (wrkstreamco.com), booking a demo, or engaging our services, you agree to be bound by these Terms. If you do not agree, please discontinue use of our website and services immediately.
2. Services
WrkStream provides AI-powered business automation services including but not limited to:
AI lead response and follow-up automation
Missed call text-back systems
Appointment scheduling and reminder automation
Review and reputation management
Referral automation campaigns
Customer reactivation workflows
Business analytics dashboards
Custom CRM and pipeline configuration
The specific services provided to each client are outlined in a separate Service Agreement executed at the time of onboarding.
3. Demo Calls and Consultations
Booking: By booking a demo call through our website, you agree to provide accurate contact information including your name, phone number, email address, and business details.
SMS Consent: By providing your phone number during the booking process, you expressly consent to receive SMS text messages from WrkStream related to your appointment, including confirmations, reminders, and follow-up communications. Message and data rates may apply. Reply STOP to opt out at any time.
No-Shows: We reserve the right to cancel or reschedule appointments for clients who miss scheduled demo calls without prior notice.
4. Client Responsibilities
As a client of WrkStream, you agree to:
Provide accurate and complete business information required to build and configure your automation systems
Obtain all necessary consents from your own customers before enrolling them in automated SMS or email communications
Comply with all applicable laws and regulations including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state regulations governing electronic communications
Use our services only for lawful business purposes
Not use our systems to send spam, harassing, or fraudulent communications
5. SMS Compliance and TCPA
WrkStream builds automation systems that send SMS messages on behalf of our clients. As a client, you are solely responsible for:
Ensuring your customers have provided express written consent to receive automated SMS messages
Maintaining records of customer consent
Honoring all opt-out requests (STOP messages) immediately
Complying with all federal and state SMS marketing regulations
WrkStream is not liable for any TCPA violations or regulatory penalties resulting from your failure to obtain proper consent from your customers.
6. Payment Terms
Setup Fees: A one-time setup fee is due prior to or at the time of system configuration, as outlined in your Service Agreement.
Monthly Retainer: Ongoing monthly fees are due on the same date each month. Failure to pay within 7 days of the due date may result in suspension of services.
Refunds: Setup fees are non-refundable once system configuration has begun. Monthly retainer fees are non-refundable for the current billing period.
Payment Processing: Payments are processed through secure third-party payment processors. WrkStream does not store payment card information on its servers.
7. Intellectual Property
All automation systems, workflows, templates, and configurations built by WrkStream remain the intellectual property of WrkStream until full payment is received. Upon full payment, clients receive a license to use the configured systems for their business operations.
WrkStream retains the right to use anonymized system configurations, workflows, and templates for internal development and to serve other clients.
8. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary business information shared during the course of the service relationship. Neither party will disclose the other's confidential information to third parties without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, WrkStream shall not be liable for:
Any indirect, incidental, special, or consequential damages
Loss of revenue, profits, or business opportunities
Interruptions in service caused by third-party platforms (including GoHighLevel, SMS carriers, or email providers)
Any damages resulting from your failure to comply with applicable laws and regulations
Our total liability to you for any claims arising from our services shall not exceed the total amount paid by you to WrkStream in the 3 months preceding the claim.
10. Service Termination
By Client: You may terminate services by providing 30 days written notice to [email protected]. You remain responsible for all fees due during the notice period.
By WrkStream: We reserve the right to terminate services immediately if:
Payment is not received within 14 days of the due date
You violate these Terms or applicable laws
You use our systems for unlawful or harmful purposes
Upon termination, WrkStream will provide reasonable assistance in transitioning your data and configurations.
11. Third-Party Platforms
WrkStream builds automation systems using third-party platforms including GoHighLevel. We are not responsible for outages, changes, or disruptions caused by third-party platform providers. Service interruptions caused by third-party platforms do not entitle clients to refunds or service credits.
12. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results including lead volume, conversion rates, or revenue increases. Results vary based on your business, market, and implementation.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Wake County, North Carolina.
14. Changes to Terms
We reserve the right to update these Terms at any time. We will notify clients of material changes via email. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
